前回は2010年度新規H-1B申請を行ったF-1学生の滞在ステータスに関し、2009年10月1日を就労開始日としてアメリカ国内にてF-1からH-1Bへのステータス変更を基にしたH-1B申請を行ったF-1学生には、一定の条件のもと、そのH-1B申請が審査中または認可されれば自動的にアメリカ滞在延長が認められるという移民局の発表内容をお伝えいたしました。
今回はそれに関連して、移民局が発表したQ&Aを紹介致します。
Q．もし移民局による新規H-1B申請受付時点でOPTが切れていた場合、F-1ステータスは延長される気がするのですが、OPTによる就労も延長されるのでしょうか？
A．自分が提出した新規H-1B申請書を移民局が受け取った時点では既にOPTは終了していても、その後の60日間のグレースピリオド期間中であれば、Cap Gapルールの下、自動的に滞在の延長は認められます。しかし申請受付時点でOPTが有効ではないためCap Gap期間中の滞在延長とあわせて就労が延長されることはありません。
Q．Cap Gap延長により自動的な滞在延長または就労の延長を得ることができれば、その後H-1B申請が却下また取り消しとなっても、そこから60日間のグレースピリオドを得ることはできるのでしょうか？
A．このようなCap Gap対象ケースでは基本的に移民局による却下、取り消しなどの通知から60日間のグレースピリオドを得ることができます。ただし却下ケースのうち、アメリカ国内でのステータス変更そのものが却下理由となっている場合は、ステータス違反ということで、この却下からの60日間のグレースピリオドは認められません。同様に申請詐欺が見つかり申請や認可が取り消しとなった場合もこの60日間のグレースピリオドは与えられません。従ってこれら結果を受けたF-1学生は直ちにアメリカを出国しなければなりません。
Q．Cap Gap延長期間中、F-1学生はアメリカ国外へ出国し、F-1ステータスとして再度アメリカに入国することは可能ですか？
A．法律上、有効なOPTカードを持っている学生については有効なF-1ビザ査証とOPTカードをもとに、一時的な休暇後、再度雇用を開始するためにアメリカに再入国できる可能性が記載されています。しかし定義上、Cap Gap延長に基づいて就労している学生についてはそれは認められておらず、その期間一旦アメリカ国外へ出国すれば（I-94が回収されれば）、申請したH-1Bが認可されることを条件に、米国外の米国大使館・領事館にて面接を受け、H-1Bビザ査証を取得してアメリカへ再入国する必要があります。H-1Bによる就労が10月1日以降であることから、Cap Gap期間中に出国する場合、その就労開始に合わせて渡航計画を立てるべきでしょう。
Q．Cap Gap延長期間中に非雇用期間の制限がありますか？
A．Cap Gap延長期間中も引き続き90日間の非雇用期間があってはなりません。これは通常のOPTルールと同様の適用です（STEMによるOPT延長期間は除く）。
Q．新規H-1B申請時点でOPTの有効期限が過ぎていたのですが、Cap Gap延長を通して再度F-1学生として就労することは可能ですか？
A．その場合、就労はできません。Cap Gap延長を基に就労を続けるためには移民局によるH-1B受け付け時点でOPTが有効でなければなりません。
