米国労働局による労働認定申請フォーム（Labor Certification Forms－ETA 9035 (LCA) 及びETA 9089 (PERM)）の改訂.

今年2月、メリーランド州ボルティモアで開催された労働局主催の労働認定申請フォーム改訂に関する説明会- “Public Briefing on Using the Redesigned Labor Certification Forms”に出席しました。その説明会の主な目的は、移民法弁護士など各関係者に対して、改訂されるフォームETA 9035 (H-1B申請で提出するLCA用) and ETA 9089 (永住権申請で提出するPERM用)の使用方法を解説することでした。その説明会で労働局は今回のフォーム改訂は単にデータ収集方法が変わっただけで、申請上の法的方針には変更がないことを強調していました。

労働局管轄の外国人労働認定許可局（OFLC）はこのH-1B申請に必要なLCAとPERM申請の両方に対してiCERTシステムと呼ばれる新しいポータルシステムの導入を発表しました。2009年4月15日、OFLCはこのiCERTシステムを通して新しいLCAフォームによる労働認定許可申請の受付を開始します。またPERMについては7月1日からの導入となります。ただ双方ともそれぞれの受付開始日から30日間のシステム移行期間を設ける予定で、その期間は従来の申請フォームも受け付けることになり、その期間を利用して新iCERTシステムのアカウントやサブアカウントの作成など新システム導入に備えた必要な作業を行うことが出来ます。

この新システムの最も大きな利点はシステム利用者が一つのアカウントから様々な申請ケースのケースステータスを確認できるという点です。また一旦入力した特定の会社情報や外国人情報等は自動認識されるため、申請書記入に関する作業時間が大幅に短縮されることでしょう。

実際、双フォームとも様々な点で改訂が施されておりますが、特記すべき点は下記の通りです。

PERM フォームETA 9089：
1) 外国人就労者名の記入スペースがフォームの最初に移されました。ここに記入する情報はシステムに自動認識され、当フォームの別パートの関連セクションに自動表示されます。
2) 追加就労場所のオプションがフォームに追加され、詳しく説明できるだけの記入スペースが設けられました。
3) 申請上の特定の職務に対し、求人活動する必要条件として加える“業務上の必要性”(business necessity)について、スポンサーとなる雇用主がその必要性の説明を記載するスペースが追加されました。“業務上の必要性”に関する一つの例としては、特定のポジションに対して日本語など外国語の能力の必要性を条件とする場合で、その場合なぜそのポジションで日本語を必要としているのか説明できるスペースが設けられたというわけです。これにより労働局はこの日本語の必要性についてフォームの説明から理解することができるため、恐らく日本語の必要性に関する監査は減ることが予想されます。
4)　2009年7月１日が新フォームの受付開始日で、アカウントの作成は2009年7月1日以前でも可能です。

LCA フォームForm ETA 9035：
1) LCAオンライン申請後、認証を得るまで最大で7営業日かかる予定です。これまでのように申請後直ちに認証を得ることができなくなります。これは労働局が詐欺申請がないか等、より入念な審査を行うことを目的としています。基本的にフォームの内容は従来のものと同じですが、フォーマットは異なります。フォームの最大の変更点は就労する外国人がどのようなH-1B申請（H-1Bへのステータス変更申請、H-1B同時申請、またH-1B延長申請）を行うかの質問が加えられているという点です。
2) 2009年4月15日が新フォームの受付開始日で、従来のフォームは2009年5月15日までは受け付けられます。
