ビザスタンプの期限と滞在許可期間の違い

私たちが受ける様々な質問のうち、特にビザスタンプの期限と実際のアメリカ滞在許可期間の違いについて同じような誤解をしているケースが多くあります。今回はこの違いについて解説したいと思います

アメリカに入国する際に入国審査官に滞在の目的や期間を伝えると、入国管理官は入国目的に応じた滞在期間を決め、I-94という小さなカードにその滞在可能な期間を記しパスポートにホッチキスで止めます。I-94は飛行機の中で書き込む出入国記録カードで、ビザを持っている人は白色、ビザウェイバーの人には緑色のものとなり、アメリカの滞在を決める大変重要な書類です。しかしながらこの小さなカードがアメリカ滞在中は非常に大切な書類である事を意識している人はそれほど多くないのが現状かもしれません。

I-94はアメリカを出国する際に回収され、移民局によって入国日と出国日が管理されます。このカードに“WT”と記されている場合はビザウェイバーでの入国を意味し、滞在期限の延長やアメリカ国内でのビザの申請は出来ません。“D/S”はステータスが有効である限り滞在可能という意味で、ステータスが切れてしまうと同時に不法滞在となるので注意が必要です。例えばF-1ビザなどで米国へ入国した際にはI-94にはD/Sと記されるため、この場合、有効なI-20を保持していればF-1保持者として学生である限り滞在が可能となります。いわゆる学生とは学校側が学生であることを認め、いつでもI-20を発行してくれる状態のことを言い、例えビザスタンプの期限が切れていてもこの状態であれば不法滞在とはなりません。逆に名前だけの学生で欠席が多かったり、中退した場合、パスポートのビザの期限が有効でもI-20がキャンセルされ、SEVISが有効でなくなる可能性もあり、またそうなった場合は合法的な滞在とはなりません。学校側は移民局に対して定期的に各外国人学生に関して報告する義務があり、こういった退学処分の旨の報告が当局で正式に受け取られた時点で学生ビザは無効となります。

一方、Eビザの場合を例にとってみましょう。Eビザスタンプは通常発行から5年間有効ですが、このEビザでアメリカに入国した場合には通常2年間の滞在許可がもらえます。しかし状況によってはその期限になる前にビザスタンプが切れてしまうケースが考えられます。例えば2009年5月10日まで有効なEビザスタンプを持つAさんが2008年5月4日にアメリカに入国し、2年間の滞在許可をもらったとします。2009年5月10日がやってきた時点でAさんのパスポートにあるEビザは切れてしまいますが、申請どおりの就労を続けている限り、不法滞在にはなりません。この場合、滞在許可は2年後の2010年の5月3日までなので、それまでは合法的に滞在が可能というわけです。ただし仮に2009年の5月10日以降アメリカ国外へ出国しアメリカへ再入国するためには新しいEビザスタンプを取得する必要があります。またもう一つ注意しなければならない点は、アメリカ入国の際に2年間滞在許可がもらえるつもりでいても、パスポートの期限がその2年よりも短い場合、I-94上の滞在期限がパスポートの有効期限に合わされることもあるということです。例えばパスポートの有効期限がアメリカ入国の3ヶ月後だとすれば、2年ではなく、パスポートの有効期限までの3ヶ月間しか滞在が認められないと言うケースも考えられます。更に入国審査官が記載ミスをすることもありますので、入国の際、特にI-94の滞在期限に気を止めず、駐在員の家族など気づかないうちに不法滞在になってしまっているケースもあるので、滞在許可期限には注意が必要です。

簡単に例えると、ビザスタンプはアメリカへの入国する際の通行手形のようなもので、I-94が滞在許可書と言えます。1997年4月1日以降、I-94に許可された期間を超えて米国に不法滞在した場合、その不法滞在期間が180日以上1年未満の場合、離米した日から3年間、不法滞在期間が1年以上の場合、離米した日から10年間米国への再入国を認められません。このようにパスポートに貼りつけられているビザスタンプの期限が滞在期限というわけではありませんので、十分にその日付に余裕があるとしてもご自身のI-94の日付を再度確認してみてください。
