H-1B詐欺申請の調査報告 その１

シンデル法律事務所ではこれまで移民関税執行局（ICE）をはじめとする政府による企業の不当な雇用および従業員管理に対する取締り強化について様々な記事を提供してきました。今回も政府による移民法に関わる企業への調査、監査についてで、日系企業も多く関わるH-1Bビザ申請について政府が実施したH-1B申請上の詐欺に関する調査・監査の報告を取り上げ、3回に分けて紹介いたします。

2008年9月、国家安全保障・記録検査局（NSRV）の部署の一つとしてビザ申請に関わる詐欺の発見と国家の安全保障を担っているFDNSオフィスよりH-1B申請における詐欺行為及びコンプライアンス（法令順守）違反について調査報告がありました。今回FDNSは調査対象とした会社を実際に訪問しましたが、その主目的は会社そのものの存在確認、雇用場所の確認で、ビザ取得者個人に関しては申請上の雇用条件通りに職務についているか質疑応答を通して確認することでした。FDNSオフィスによる今回の報告概要は次の通りです。

移民局及び移民関税執行局は共同の詐欺防止策に従い、FDNSを通してビザ申請上の詐欺・コンプライアンス査定 (BFCA)プログラムを実施しますが、調査結果を受け、申請者(スポンサー会社)またはビザ取得者個人が詐欺を犯していると結論付けた場合、FDNSはそのケースを正式な犯罪調査及び刑事告訴対象ケースとして検討するよう移民関税執行局へ照会することになります。移民関税執行局は一旦ケースを受け取れば60日以内に犯罪調査対象として正式に受け入れるか、または照会を却下してケースをFDNSへ戻すか判断することになります。

もし移民関税執行局が犯罪調査としてケースを受け入れなければ、FDNSはそのケースを管理上詐欺発覚ケース(administrative finding)として移民局に転送し、必要に応じて申請は却下もしくは撤回されることになります。現在の政府方針によれば、もしビザ取得者個人がアメリカに滞在しているということであれば、自国への強制送還がなされます。

更に、詐欺発覚に関し、対象となったビザ取得者個人が強制送還に従わない、または他のビザステータスへの変更を行わない場合についての取り決めも存在します。FDNSの移民捜査官はそのBFCAケースをFDNSデータシステム(FDNS-DS)へ情報として入力しますが、入力された情報は追跡可能で、関係するビザ申請者（スポンサー会社）が他の人のビザ申請を行ったり、同一人物が違う種類のビザ申請を移民局へ行った場合、そのデータベースを通してそれらケースと詐欺に関わる情報とを比較することも可能となります。

H-1B申請においてはビザ取得者個人からではなく、雇用主が移民局へ支払わなければならないトレーニング費等存在します。その費用に対し、申請後追って企業が従業員にその額分を請求することは問題の引き金となりますが、その企業対応に関連して、移民法には次のような記載があります。“合法的に認められていないあらゆる賃金からの控除は、労働省により賃金の不払いとして扱われる。更に雇用主が従業員に対して会社のビジネス上のあらゆる経費分を課すことで、従業員の賃金がH-1B申請上支払うと誓約した必要最低賃金以下になる場合、たとえ控除としてビザ取得者個人の給与明細に掲載が無いとしても、労働省は差し引いたその経費額を合法的に認められていない賃金からの控除と見なすでしょう”と。従ってスポンサー会社である雇用主は、H-1B申請上、会社が支払わなければならない費用をビジネス上の経費としてビザ取得者個人から額分を差し引くことができないことを意味します。今回実施された調査内容の１つにはこの規則に会社が従っているかも含まれていました。次回は実際に実施されたH-1B申請詐欺調査方法及び結果について具体的に紹介いたします。
