米国関税局（CBP）は、全てのアメリカ国境における身体検査や荷物検査をする権限を長い間有しています。しかし最近では、当関税局はアメリカの国境で出入国をしている外国人旅行者のノートパソコン、携帯電話、ブラックベリーや電子手帳といった電子機器までも細かく調査をするようになりました。時折、当局は旅行者に対してロックされているファイルや暗号化されたファイルをチェックするために暗証番号の入力を求めることもあります。当局調査官はテロリズム、著作権違反、児童ポルノグラフィーの所持や持込みを始めとして米国貿易法施行そのものも、これら国境での電子機器調査を含めた調査の厳格化に繋がっていると主張しています。

各機関の専門家によれば、これら増え続ける強硬な調査に対して警告を発しています。この強硬調査の増加に加えて当局の新しい調査に使われる技術により当局はパスワードの解読、インターネット接続記録の調査、保存データコピー、携帯電話からの情報収集（SMSメッセージ、電話帳、着信受信履歴、マルティメディアメッセージ）が可能となっています。更に当局の係員や調査官は日常の関税検査の際に機密情報や文書、企業秘密、パスワードなどの機密情報にアクセスすることも可能であろうと推測しています。

2008年夏に発表された政策綱領（policy statement）には、これら調査及び特定の事情における電子データや電子機器の押収に関する事項が明記されています。そこには当局の調査に対する権限が改めて明記されており、更にそれら調査に関する特定の指針も記載されています。更にその政策綱領の中には、通常は秘密が守られるべきビジネス、商業に関する情報、そして弁護士・顧客間の秘匿情報などに対する調査官による詳細な調査方法が記載されています。

連邦条例によると、アメリカへ入国する者は入国の際、その商業品を含む所持品が関税局員によって調査されることになっています。ただ最高裁判所は関税局調査官による行為に関して制限を設けています。最高裁は国境調査官が容疑や令状なしに日常的な検査をする権限を認めていますが立ち入った身体検査を行うためには一定レベルの容疑が必要としており、その理由として個人の尊厳やプライバシー保護を挙げています。しかしながら最高裁は関税局員がアメリカ国境で外国人が所持する電子機器に対する検査に関しては制限を設けていないのが実情です。

最近の第９巡回裁判所のケースでは関税局調査官がアメリカに出入国している外国人旅行者に対して、容疑なしに電子機器の検査をすることを認めました。その一つの事例としてMichael Arnold氏はフィリピンでの休暇からアメリカへ帰国した際に、パソコンに児童ポルノグラフィーを所持していることを発見され、意図的に児童ポルノグラフィーを所持し、持ち込んだという罪に問われました。第９巡回裁判所は国境でのその国への危害を回避するという国益は個人のプライバシー権を上回ること、そしてノートパソコンを含む所持品の厳格な検査は、強硬的な身体検査と同様に発生する尊厳やプライバシーに関する懸念を引き起こすことはないという判決を下しました。従って、そのような検査は日常的検査とみなされ、一定レベルの容疑を必要としないということになります。ただ裁判所は調査対象となった旅行者が関税局員へパスワードを教える義務があるかという点については触れませんでした。一方で、バーモントの地方裁判所はパスワードを強制的に教えさせることは米国憲法修正条項第５条の自白強制に関する権利の侵害にあたると決定しています。
米国国土安全保障省や当関税局がどの電子機器を検査したり押収するかを決定するのに適用される手続きは不明確なままです。しかしながら関税局員による電子機器の捜査を拒否したり、パスワードを提供しない場合、米国入国が遅延したり、入国拒否されたり、その電子機器が没収されてしまったりする可能性があります。従業員や著作権、ビジネスの機密情報を守るために企業は従業員の渡米中、電子機器に保存された機密情報を完全に保守するための戦略を実行しています。例えば：

* ハードドライブに一切データの保存されていないノートパソコンの使用
* 機密情報の暗号化
* 機密情報の削除
* 暗号化された媒体を通しての情報の遠隔アクセス
* Emailによる機密情報の送受信
* 社外秘ファイルの明確な識別化

これまで様々な形で米国政府により取締りの厳格化について記事を書いてきましたが、これら動きをみても米国政府は容疑、調査、執行に関して新たな取り締まりの厳格期に入ったと言えます。今回の記事は米国政府による単なる個人のプライバシー件に対する侵害の一つの例に過ぎません。今後の動きには注目です。
