OPTの17ヶ月延長について

先月、米国移民局はSTEM （専攻：Science、Technology、Engineering、Mathmatics）学生に対し、そのOPT期間を、これまでの12ヶ月（F-1学生）から17ヶ月間延長し、29ヶ月間とする新しい法律を発表いたしました。

具体的には下記の専攻となります。

- Actuarial Science
- Computer Science Applications
- Engineering
- Engineering Technologies
- Biological and Biomedical Sciences
- Mathematics and Statistics
- Military Technologies
- Physical Sciences
- Science Technologies
- Medical Scientist (MS, PhD)

上記の専攻が17ヶ月のOPT延長の対象となりますが、正確にはCIPコードにて確認することになります。CIPコードとは全ての学問プログラムに対して割り振られたDepartment of Educationコードのことで、アメリカの学校は学生の専攻プログラムが指定のCIPコードリストと合致するか確認することになります。

この17ヶ月の延長申請に関して必要な条件は次の通りです。

- 対象となる学生は12ヶ月のOPTプログラムを基に、自分の専攻と直接関連した分野においてアメリカの会社で勤めていること
- 対象となる学生はSEVISに対応しているアメリカの大学においてSTEMの専攻にて大学学士号、修士号、博士号を卒業していること
- 対象となる学生はE-Verify雇用認証システムに登録された雇用主から仕事のオファーを受けていること
- 対象となる学生はSTEM専攻の学位取得後、過去に17ヶ月のOPT延長を受けたことがないこと
- 大学のInternational Student Officeは申請者のOPT期間のステータス維持の正当性を確認し、必要とされているSTEM専攻であるかなど、OPT延長申請の有資格者であるかどうかを確認した後、SEVIS上でこの17ヶ月のOPT延長を学生に勧めることになる
- 対象となる学生はI-765申請を行うことになり、申請には必要な申請書類と移民局への申請費用を支払うことになる
- 対象となる学生はもしこの17ヶ月のOPT延長申請を現在のステータスが切れる前に申請すれば、その申請中は結果が出ていなくてもI-765の結果が出るまでの期間、もしくは180日間（どちらか早い期限まで）も就労を続けることができる。
- 雇用主はDSO（Designated School Official: 指定の学生アドバイザー）に対し、OPTでの就労者が会社を自主的に辞めたり、辞めさせたりした場合、その雇用終了を移民局が今後指定する方法（現在未定）にて報告することに同意しなければならない。実際の雇用主はOPT就労者が会社を退社したことを知った時点を雇用就労とし、雇用主の同意無しにOPT就労者が連続して5営業日の間、出勤しない場合も雇用終了と会社は判断することになる。

なお17ヶ月の延長OPTが認可された後、変更が発生した場合など様々な状況で移民局への報告義務がありますので御注意下さい。
