DV-２００７の結果やUSCISプレミアム申請適用範囲の拡張について

☆ DV-2007の結果

皆さんの中にもDV-2007に申し込みをされた方もいるでしょう。DV-2007申請の処理は例年同様、国務省管轄のケンタッキー領事センターにて行われ当選者には随時発表が行われました。当選者のうちビザ取得の条件を満たさなかったり当選後のビザ取得までの過程を正当に追従しない人が出てくることもあるのでDV-2007が５万人に対して有効なのに対し今回は約8万2千人に対して当選登録通知書が送られました。今回は応募総数は約550万件（申請条件を満たすもののみ）で、日本の当選者数は333件でした。しかしながら仮に自分に当選通知が送られてきても確実に永住権が与えられることを意味しません。番号の問題もありますが例えば米国に不法滞在している人も万が一、当選したとしても最終的にこのプログラムを通して永住権を取得することはほぼ不可能でしょう。当選通知書を受け取りその登録を済ませた人のうち、割り当て番号の数字の少ないほうから随時面接になります。その当選登録者に対する実際の面接は日本在住者であれば東京大使館で、米国在住者であれば米国内もしくは日本での面接を選択することができます。

さて2008年度DVについてですが、この記事を書いている現時点では今年も昨年度と同様にプログラムが実施されるかはっきりとはしておりません。参考までに昨年は2005年10月5日から2005年12月4日までオンラインによる申請受付が実施されました。DVに関し新しい発表がありましたら随時お知らせできればと考えております。詳しいDVの情報につきましては www.dvlottery.state.govよりご確認下さい。

☆ USCISプレミアム申請適用範囲の拡張

2006年8月18日付けの移民局による発表により2006年8月28日より、永住権申請の第2段階であるI-140申請のプレミアム申請の受付が開始されました。ただこの受付は数あるカテゴリーのうち、EB３と呼ばれるカテゴリーで申請する場合が適用され、EB3 ProfessionalそしてEB3 Skilled Workerが含まれます。それ以外は適用対象外です。またそれに合わせる形で今回移民局は8月28日を境にプレミアム申請に必要なI-907フォームの改訂を行いました。8月28日以降はこの新しいI-907フォームによる申請となっておりますので、ご注意下さい。

プレミアム申請とは移民局に$1000の審査費用を支払うことにより、移民局による正式な受付から15日以内に結果が出ます（質問状が出る場合もある）。もし移民局がその15日以内に審査しなかったということであればその$1000は払い戻され、申請そのものも引き続きプレミアム申請扱いで審査されます。このプレミアム申請は2001年に開始されましたがこれまでI-129申請（E、H-1B、H-2B、H-3、L、O、P、Q、R等）において有効なものでした。これらについてもビザの数が有効である限り、引き続き、プレミアム申請が可能です。

☆ I-140審査の状況

雇用ベースの永住権申請の通常第2段階はI-140申請と呼ばれます。これは移民局に提出するいわゆる移民申請のことですが、第一段階のLCについて労働局からの認定がされて後、申請できます（EB1カテゴリーは労働局段階は不要）。これは会社が実際にビザ受益者に対して必要な給与額を支払う能力があるか、またビザ申請者自身もポジションに必要な条件を満たしているか等を示す必要があります。この審査期間はこれまでは数ヶ月かかっていましたが、最近では1-2週間で結果が出ているものもあります。ただこれはケースによってばらつきがあり、いぜん数ヶ月かかっているケースもあるのが事実です。今後とも様々なケースにおいていち早い結果が出ることを切に望むとともに今後、時間のかかっている方はプレミアムをかけることでいち早い結果を得ることも可能になりましたので、このI-140段階は比較的時間的なコントロールがし易くなったと言えるかもしれません。特にH-1Bの7年目以降の延長申請がある人は既定以内に労働局申請を行い、その認可のもとI-140申請がなされ、最終の第3段階目に進むのを待っている場合であれば1年ごとではなく3年の延長も可能ですので、このいち早いI-140認可はたいへん魅力的と言えるでしょう。
