☆ H-1B取得は難しいのでしょうか

今回の題目に対して、現時点でその取得の可能性を尋ねられれば、一部の例外はありますが、H-1B取得は不可能という答えになります。読者の皆さんの多くがご存知のことかと思いますが2007年度の新規H-1Bの申請受付は受付開始から２ヶ月弱で締め切りとなりました。ただ先日行われた中間選挙により民主党が下院で多数派を奪還したことを受け、一つの明るい望みとして今後H-1Bの年間上限枠増加に関する法案が通過する可能性もあるでしょう。ただこの法案が議会を通過しない限り次回の新規H-1B申請は早くて今年の4月以降となります。

一方、実際のH-1B申請に関して移民局は審査のポイントとしてどのような点を見ているのでしょうか。例えば大学学位以上をもつ人が持ち合わせている専門能力を必要としないようなポジションに就く外国人のH-1B申請に対して移民局は特に厳しい姿勢をとっています。逆に会計士やコンピューターエンジニアのような専門の学位を必要とするようなポジションに対してのH-1B申請は比較的柔和な姿勢をとっているとも言えるでしょう。一方で、サービス業や接客業、PR業、芸術家の職として雇用される場合は、しばしば認可を得ることは難しいことが多いようです。

このようにH-1Bビザとは“専門技術者”としてその能力を持った人が、その専門知識を生かす専門職ポジションで働く外国人に与えられるもので、移民法のSection 214(i)(1)にはそのH-1Bに相当する専門職について、その高い専門能力をもとにその知識を理論的、実用的に応用する必要のある職であること、また米国において大学学位かそれと同等以上のものを持った人しか持っていない専門能力を必要とする職と定義しています。

これら専門能力の必要性について、注目すべきケースがありますので一つ紹介します。

ここで取り上げるケースは2002年に遡りますが、移民局（カリフォルニアサービスセンター）に提出されたH-1B申請書が一度は却下されたものの、その後アピールセンター（AAO）においてはその却下に対するアピール申請が覆され、最終的に申請が認可されたというケースです。この申請はペストリーシェフに対するH-1B申請で、移民局側は当初ペストリーシェフは大学学位を必要とする専門職ではないということで申請を却下しました。このようなケースにおいて移民局側が申請ポジションが専門職であるかどうかを判断する基となるデータベースとしてOccupational Outlook Handbook（OOH）というものがあります。これはオンライン上でも確認できますので、申請の際は申請ポジションが専門職であるかどうかを確認してください。（www.bls.gov/oco）移民局はこのデータベースを基に、申請ポジションが専門職ではないと判断すれば質問状をだすか、場合により却下を下すケースがあるというわけです。このペストリーシェフのケースにおいても移民局側はOOHのデータを基に却下を下しましたが、AAOはこの決定を最終的に覆しました。その理由としてH-1B申請書に書かれてあるペストリーシェフの職務内容はOOHに記載されている職務内容に比べてより複雑なものであったというものでした。職務内容の中には他に3人のシェフがおり、かつ独特なペストリー業を行わなければならないレストランのペストリー部門を監督するというものもありました。更にメニュー作り、レシピ考案、コスト管理、準備作業の指示など、管理業も含めたフランス菓子作りの統括的な役割を担うというものでした。

このケースからも分かるようにポジションによっては職務内容など申請に応じて詳しい説明書きが必要となるものもあると言えます。例えば小規模な出版社におけるBusiness Analyst、小規模な保険会社におけるEmployee Relations Specialist、旅行会社におけるHospitality Marketing Analyst、人材派遣会社におけるHR Specialist、自動車部品サプライヤーにおけるLabor Relations Specialist、プロダクション会社におけるMedia Production Coordinator、小規模な学校におけるPhysical Education Teacher、非営利政府機関におけるProgram Officer、コンサルティング会社におけるProject Specialist、翻訳会社におけるTechnical Translatorなどがあります。これらすべてのケースにおいては、例えば大規模な会計事務所の会計士に対する申請書の内容に比べ、より詳細な説明が必要となるというわけです。従ってこれらのポジションもそうですが、OOHよりはっきりと専門職であることが判断できない場合はポジションが専門職であることを詳しく説明する必要があります。更に注意すべき点は仮にポジションそのものがOOHでははっきりと専門職であると判断できる場合でさえも移民局は会社のサイズやそのビジネスタイプを注意深く考慮し、場合によってはその専門職が会社にとって又業界としては大学学位以上の専門能力を必要ないと判断する場合もあります。従って移民局は単にポジションそのものが専門知識を必要とするというポイントだけで判断しているわけではなく、それ以外の要素も様々な角度から検証し、判断しているというわけです。

このように、H-1Bの申請を考えている雇用主は申請の際は職務内容の記載には十分注意が必要です。特にOOHでは大学学位を必要としない場合はその職務内容はたいへん複雑で大学学位を必要とするものであるというその正当性を詳しく述べることが大切でしょう。当然のことながら雇用主側が以前に同様のケースで他の従業員にて認可を受けたことがある場合はその情報を移民局に知らせるのも一つの方法でしょう。また業界としてそのポジションが必要であるというような記事やレター等申請ポジションに大学学位以上の専門能力が必要であることを裏付けることのできる書類もプラス材料となる可能性があります。

もしポジションそのものだけではなく業界としても大学学位以上の人が持つような専門能力を必要とせず、且つ雇用主側も申請ポジションの複雑さを説明できないとすれば申請は却下される可能性が高くなると言わざるを得ません。
