☆ 今移民局申請費用値上げ・永住権申請に関する最近の動向・永住権申請におけるSubstitution申請の終了についてご紹介します。

移民局申請費用値上げ

2007年7月30日付けで移民局の申請費用が大幅に値上がりとなります。移民局はこの値上げをきっかけに現在抱えている多くの残務処理を行うことができると予想していますが、これを受け7月29日以前に多くの申請が殺到することが予想されます。以下が皆さんの多くに関係しそうな代表的な新しい申請費用を紹介いたします（I-485など申請の種類によっては年齢及び特定の条件に応じ値段が違うものもあります）。
I-90(永住権の更新申請)–$260→$370
I-129（H-1B、L、E、Oビザなど非移民ビザ申請）–$190→$320（ビザの種類により更にトレーニング費やFraud費など追加費用がかかる）
I-131(永住権保持者の再入国許可申請)–$170→$305
I-140（雇用をもとにした永住権申請に関する移民申請）–$195→$475
I-485(米国内での永住権保持者へのステータス変更)–$395(指紋採取含む)→$1,010(EADカード、アドバンスパロール含む)
I-539(H-4など非移民ビザの延長申請)–$200→$300
I-765(EAD就労許可申請)–$180→$340
N-400(市民権申請)–$400(指紋採取費用含む)→$675(指紋採取費用含む)

永住権申請に関する最近の動向

皆さんの中にも雇用を基にした永住権の申請を既に開始したにもかかわらず、その年間発給数以上の申請が殺到していることで永住権取得のための最終段階に進むまで長年の順番待ちに陥っている方もいるかも知れません。つい数ヶ月前までは、永住権申請のEB3という申請カテゴリーにおいては2002年8月以前に永住権申請を開始している人でなければ、永住権申請の最終段階まで進めない状況でした。しかしここ最近、それが数年、数ヶ月単位で短縮され、6月半ばに発表されたVisa Bulletin（7月）では、一切の順番待ちがなくなりました。これは驚くべき進行でした。しかしながら2007年7月2日、移民局は雇用を基にしたAOS申請（アメリカ国内でのステータス変更申請）に関し、全ての申請カテゴリーにおいて2007年9月30日までは一切受け付けないと発表いたしました。つまり2007年10月1日の少なくとも新年度まではAOS申請はできないことを意味し、移民局へ申請する場合、自動的に申請費用が値上がりした後での申請と言うことになります。今後、いつどのような形で申請受付が開始されるか容易には予想できませんが、今後の動向には引き続き注意が必要です。仮に自分自身の申請が可能となった場合、AOS申請を行うか、それとも日本の米国大使館を通しての申請を行うか、それぞれのメリットを考慮に入れた上での判断が必要となるでしょう。

永住権申請におけるSubstitution申請の終了について

これまでは永住権の第１ステップである労働許可申請認可後の労働許可(LC)を次のステップのI-140移民申請においてSubstitutionとして申請することができました。しかし労働局より07年7月16日付けでそのSubstitution申請を廃止する法律改正が発表されました。つまり仮にLCには名前が載っていないものの、一定の条件を満たす別の申請者への変更ができなくなったというわけです。ただそれまでに提出したSubstitution申請はその日付を超えても引き続き審査の対象となります。一方、今回の発表を受け、I-140申請を受け付ける移民局は第一段階で認可されたLCのSubstitutionを基にしたそのプレミアム申請を終了するとも発表いたしました。
