☆H-1Bビザ修正申請について（その１）

H-1Bビザの申請を考えている雇用主の多くは、H-1Bビザの上限数のことを考え、ここ数年4月の申請受付後の申請の締め切りが年々早くなっているのが気になっていることでしょう。しかし、H-1Bビザが認可されても、雇用主はその時の申請内容を常に頭に入れておかなければなりません。なぜならば、雇用条件が変わることによって、そのH-1Bビザの正当性に影響が出てくるからです。例えば、企業合併や買収、市場のニーズが変わったことによる仕事内容の変更、雇用先の変更、解雇といった条件下では注意が必要です。

修正申請はいつ行うべきか？
一般的に修正申請は、雇用条件に「重要な変更」があった場合に必要です。法律文書では、「重要な変更」とは、「H-1Bビザ保有者の雇用期間や条件に根本的な変更があった場合」とだけ指摘されています。では、何を持って「重要な変更」とするのでしょうか。しばしば焦点となるのは、H-1Bビザ保持者の雇用主が変わったかどうかということです。この点に関しては、新たにビザ申請書類を移民局に提出しなければならないと法律に明記されています。

就労場所の変更
H-1Bビザが認可される際には、就労場所が限定されているため、変更があった場合には、新たなH-1B申請か修正申請を移民局に行う、新たなLCA（Labor Condition Applications）の申請、または新たな就労場所に現行のLCAの掲示するのいずれかを行う必要があります。H-1Bビザ保持者の雇用がLCAに記載されている就労地域外となり、新たな場所での就労が始まる前に雇用者が新しいLCAを提出しなかった場合、新しいLCAとともに修正申請をする必要があります。
しかし法律によれば、H-1Bビザ保持者の新たな就労場所が、LCAに記載されている「就労場所の地域内」、つまり基本的に最初の就労場所と同じ都市内であれば、そこでの就労が始まる前に雇用主が通知を掲示するだけでいいことになっています。この場合、移民局に修正H-1B申請を行う必要はありません。雇用主が勤務地の変化に伴う新たなLCAの申請をしそびれた場合には、適切な許可なしにH-1Bビザ保持者を働かせたとみなされるため注意が必要です。

職務内容の変更
H-1Bビザ保持者の職務内容が変更された場合、雇用者は新しいH-1Bビザ申請またはH-1Bビザの修正申請を届け出なくてはなりません。例えば、雇用者の下で調査をしていたマーケティング・アナリストが、顧客の下で調査を始め、さらに別の調査や職務につくことになった場合などです。
「重要な変更」があったかどうか決めるには、単なる役職名の変更よりも、実際の職務内容がどれだけ変わったかどうかが判断材料となります。審査でよく用いられるのは、新たな職務内容が別の平均賃金カテゴリーに入るかどうかという点です。

就労時間の変更
元々フルタイム（一般的に週35時間以上と定められています）の従業員の就労時間がそれ以下にならない限りは、就労時間やスケジュールの変更に関して特に届け出る必要はありません。もし元々フルタイムの就労として申請されていたH-1Bビザがパートタイムの仕事に変更された場合、「重要な」変更がなされたとみなされ、H-1B申請の修正を移民局に届け出なければなりません。
